1.1. These Terms and Conditions define the rules for the provision of services, reservation, stay, and payment at Villa-Kasia Ocean View, located at Rua Eugėnia Brandão de Melo 202, 9125-062 Caniço, Madeira, Portugal.
1.2. The owner of Villa-Kasia Ocean View, located on Madeira Island, is Katarzyna Kosydar, NIF: 304475998.
1.3. Making a reservation and using the services of Villa-Kasia Ocean View means that you have read and fully accepted these Terms and Conditions.
1.4. The Terms and Conditions are available on the villa-kasia.com website and at the reception of Villa-Kasia Ocean View.
2. Reservation
2.1. Reservations can be made:
- Via the villa-kasia.com website
- By phone at +351 910 339 135
- By email at info@villa-kasia.com
- Through booking portals with which we cooperate
2.2. Making a reservation requires providing personal data necessary for its execution, including:
- First and last name
- Email address
- Phone number
- Stay dates
- Number of guests
2.3. After making a reservation, the Guest will receive a confirmation containing reservation details and payment information.
2.4. The reservation is confirmed and guaranteed after paying a deposit or the full amount for the stay. For reservations made at least 30 days before the planned arrival, a deposit of 50% of the total stay value is required. For reservations made less than 30 days before the planned arrival, a payment of 100% of the stay value is required. Please understand that until the funds are credited to our account, the reservation is preliminary. During this time, the room may be reserved by guests using reservation portals such as Airbnb, Booking.com, or Expedia. To ensure your chosen date, we kindly ask you to make the payment within 2 days of making the reservation. Failure to pay within this deadline may result in automatic cancellation of the reservation.
3. Payment
3.1. We accept the following forms of payment:
- Bank transfer
- Card payment (Visa, Mastercard)
- Cash payment (in case of payment on site)
- Online payment via Stripe
- Link Payments (SumUp)
3.2. Payment for the stay:
- For reservations made at least 30 days before the planned arrival - a deposit of 50% of the stay value, and the remaining amount must be credited to our account no later than 14 days before arrival
- For reservations made less than 30 days before the planned arrival - payment of 100% of the stay value is required at the time of reservation
- Payment in full at check-in (cash/card) - this option is only available for guests who are already on Madeira Island and make a last-minute reservation (same day or the day before)

3.4. Upon request, we issue VAT invoices. The request for an invoice should be submitted during the reservation or at the latest on the day of the end of the stay, providing the necessary data.
4. Changing and Cancelling Reservations
4.1. Changing the reservation date is possible, subject to availability in the new period, and requires contacting the property.
4.2. In case of reservation cancellation:
- More than 30 days before the planned arrival - we refund 100% of the paid amount
- Between 30 and 14 days before the planned arrival - we refund 50% of the paid amount
- Less than 14 days before the planned arrival - no refund of the paid amount
4.3. In case of shortening the stay, the fee for the unused period is not refundable.
4.4. In case of force majeure or unforeseen circumstances preventing the stay, the decision to refund the paid amount will be made individually.
5. Check-in and Check-out
5.1. The accommodation day starts at 3:00 PM (check-in) and ends at 11:00 AM (check-out) the following day.
5.2. Early check-in or late check-out is possible depending on availability and may incur an additional fee. The request should be made in advance.
5.3. Upon check-in, the Guest is required to present an ID with a photo.
5.4. Keys to the room must be returned upon check-out. For a lost key, a fee of €20 is charged.
6. Stay
6.1. Smoking is completely prohibited in the property. Breaking this ban results in a cleaning fee of €100. This is related to additional cleaning and removal of unwanted odors, including tobacco or other substances.
6.2. Quiet hours are from 10:00 PM to 7:00 AM. During this time, Guests are required to behave in a way that does not disturb the rest of other Guests. We ask you to close doors quietly throughout your stay.
6.3. Guests are financially responsible for any damage or destruction of property equipment and technical devices of Villa-Kasia Ocean View occurring through their fault or the fault of their visitors.
6.4. Villa-Kasia Ocean View is not responsible for valuable items left in the rooms. We recommend using the safe if available in the room.
6.5. Unregistered persons may stay in the room from 9:00 AM to 9:00 PM. Additional accommodation is not expected but may be arranged with the owner's consent.
7. Pets
Pets are not accepted at Villa-Kasia Ocean View.
8. Amenities and Additional Services
8.1. As part of the accommodation fee, Guests can use the following free of charge:
- Wi-Fi
- Parking
- By prior arrangement, also an electric car charger
8.2. For an additional fee, we offer:
- Transport from/to the airport
- Additional cleaning
- Laundry
- Full-day tours around Madeira (details available from hostess Kasia)
8.3. The price list for additional services is available at the reception, on the villa-kasia.com website, and on madeiracomfortstay.com or madeira-rundreisen.de.
9. Complaints
9.1. Any comments and reservations regarding the stay should be reported directly during the stay to enable us to react quickly and improve the quality of our services.
9.2. Complaints can be submitted:
- In person at the reception
- By email to info@villa-kasia.com
- By phone at +351 910 339 135
- By mail to the property address
9.3. Complaints will be considered within 14 days from the date of receipt.
10. Personal Data Protection
10.1. The administrator of Guests' personal data is Katarzyna Kosydar.
10.2. Guests' personal data are processed for the purpose of providing accommodation services, marketing of own products and services, and for purposes resulting from legitimate interests pursued by the administrator.
10.3. Detailed information on the processing of personal data can be found in the Privacy Policy available on the villa-kasia.com website.
11. Final Provisions
11.1. For matters not regulated by these Terms and Conditions, the provisions of the locally applicable Portuguese civil law shall apply.
11.2. Any disputes will be resolved amicably, and in case of no agreement, by the court having jurisdiction over the registered office of the owner of Villa-Kasia Ocean View.
11.3. The owner of Villa-Kasia Ocean View reserves the right to make changes to these Terms and Conditions. Changes come into effect on the date of publication of the amended Terms and Conditions on the website.

2. Reservierung
2.1. Reservierungen können vorgenommen werden:

- Über Buchungsportale, mit denen wir zusammenarbeiten
2.2. Für eine Reservierung ist die Angabe der für die Durchführung notwendigen personenbezogenen Daten erforderlich, darunter:
- Vor- und Nachname
- E-Mail-Adresse
- Telefonnummer
- Aufenthaltsdaten
- Anzahl der Gäste
2.3. Nach der Reservierung erhält der Gast eine Bestätigung mit den Reservierungsdetails und Zahlungsinformationen.
2.4. Die Reservierung wird bestätigt und garantiert nach Zahlung einer Anzahlung oder des vollen Betrags für den Aufenthalt. Für Reservierungen, die mindestens 30 Tage vor der geplanten Ankunft vorgenommen werden, ist eine Anzahlung in Höhe von 50% des Gesamtaufenthaltswerts erforderlich. Für Reservierungen, die weniger als 30 Tage vor der geplanten Ankunft vorgenommen werden, ist eine Zahlung von 100% des Aufenthaltswerts erforderlich. Bitte haben Sie Verständnis dafür, dass die Reservierung bis zur Gutschrift der Gelder auf unserem Konto vorläufig ist. In dieser Zeit kann das Zimmer von Gästen über Reservierungsportale wie Airbnb, Booking.com oder Expedia gebucht werden. Um Ihren gewählten Termin zu sichern, bitten wir Sie höflich, die Zahlung innerhalb von 2 Tagen nach der Reservierung zu leisten. Bei Nichtzahlung innerhalb dieser Frist kann die Reservierung automatisch storniert werden.
3. Zahlung
3.1. Wir akzeptieren folgende Zahlungsformen:
- Banküberweisung
- Kartenzahlung (Visa, Mastercard)
- Barzahlung (bei Zahlung vor Ort)
- Online-Zahlung über Stripe
- Link-Zahlungen (SumUp)
3.2. Zahlung für den Aufenthalt:
- Bei Reservierungen, die mindestens 30 Tage vor der geplanten Ankunft vorgenommen werden - eine Anzahlung in Höhe von 50% des Aufenthaltswerts, und der Restbetrag muss spätestens 14 Tage vor der Ankunft auf unserem Konto gutgeschrieben sein
- Bei Reservierungen, die weniger als 30 Tage vor der geplanten Ankunft vorgenommen werden - ist eine Zahlung von 100% des Aufenthaltswerts zum Zeitpunkt der Reservierung erforderlich
- Vollständige Zahlung beim Check-in (bar/Karte) - diese Option steht nur Gästen zur Verfügung, die sich bereits auf der Insel Madeira befinden und eine Last-Minute-Reservierung vornehmen (am selben Tag oder am Vortag)

3.4. Auf Anfrage stellen wir Rechnungen mit Mehrwertsteuer aus. Die Anfrage für eine Rechnung sollte während der Reservierung oder spätestens am Tag des Aufenthaltsendes unter Angabe der erforderlichen Daten erfolgen.
4. Änderung und Stornierung von Reservierungen
4.1. Eine Änderung des Reservierungsdatums ist möglich, vorbehaltlich der Verfügbarkeit im neuen Zeitraum, und erfordert die Kontaktaufnahme mit der Unterkunft.
4.2. Bei Stornierung der Reservierung:
- Mehr als 30 Tage vor der geplanten Ankunft - erstatten wir 100% des gezahlten Betrags
- Zwischen 30 und 14 Tagen vor der geplanten Ankunft - erstatten wir 50% des gezahlten Betrags
- Weniger als 14 Tage vor der geplanten Ankunft - keine Erstattung des gezahlten Betrags
4.3. Bei Verkürzung des Aufenthalts wird die Gebühr für den nicht genutzten Zeitraum nicht erstattet.
4.4. Im Falle höherer Gewalt oder unvorhergesehener Umstände, die den Aufenthalt verhindern, wird die Entscheidung über die Erstattung des gezahlten Betrags individuell getroffen.
5. Check-in und Check-out
5.1. Der Unterkunftstag beginnt um 15:00 Uhr (Check-in) und endet um 11:00 Uhr (Check-out) am folgenden Tag.
5.2. Ein früherer Check-in oder späterer Check-out ist je nach Verfügbarkeit möglich und kann mit einer zusätzlichen Gebühr verbunden sein. Die Anfrage sollte im Voraus gestellt werden.
5.3. Beim Check-in muss der Gast einen Lichtbildausweis vorlegen.
5.4. Schlüssel zum Zimmer müssen beim Check-out zurückgegeben werden. Für einen verlorenen Schlüssel wird eine Gebühr von 20 € erhoben.
6. Aufenthalt
6.1. In der Unterkunft ist das Rauchen vollständig verboten. Bei Verstoß gegen dieses Verbot wird eine Reinigungsgebühr von 100 € erhoben. Dies ist mit zusätzlicher Reinigung und Beseitigung unerwünschter Gerüche verbunden, einschließlich Tabak oder anderer Substanzen.
6.2. Die Nachtruhe gilt von 22:00 Uhr bis 7:00 Uhr. Während dieser Zeit sind die Gäste verpflichtet, sich so zu verhalten, dass sie die Ruhe anderer Gäste nicht stören. Wir bitten Sie, während Ihres gesamten Aufenthalts die Türen leise zu schließen.
6.3. Die Gäste haften finanziell für alle Schäden oder Zerstörungen an der Ausstattung und den technischen Geräten der Villa-Kasia Ocean View, die durch ihr Verschulden oder das Verschulden ihrer Besucher entstehen.
6.4. Die Villa-Kasia Ocean View haftet nicht für wertvolle Gegenstände, die in den Zimmern zurückgelassen werden. Wir empfehlen die Nutzung des Safes, falls im Zimmer vorhanden.
6.5. Nicht registrierte Personen können sich von 9:00 Uhr bis 21:00 Uhr im Zimmer aufhalten. Eine zusätzliche Unterbringung ist nicht vorgesehen, kann aber mit Zustimmung des Eigentümers erfolgen.
7. Haustiere
In der Villa-Kasia Ocean View werden keine Haustiere akzeptiert.
8. Annehmlichkeiten und zusätzliche Dienstleistungen
8.1. Im Rahmen der Unterkunftsgebühr können die Gäste folgendes kostenlos nutzen:

- Nach vorheriger Absprache auch eine Ladestation für Elektroautos
8.2. Gegen Aufpreis bieten wir an:
- Transport vom/zum Flughafen
- Zusätzliche Reinigung
- Wäscheservice

8.3. Die Preisliste für zusätzliche Dienstleistungen ist an der Rezeption, auf der Website villa-kasia.com und auf madeiracomfortstay.com oder madeira-rundreisen.de verfügbar.
9. Beschwerden
9.1. Alle Kommentare und Vorbehalte bezüglich des Aufenthalts sollten direkt während des Aufenthalts gemeldet werden, um uns eine schnelle Reaktion und Verbesserung der Qualität unserer Dienstleistungen zu ermöglichen.
9.2. Beschwerden können eingereicht werden:

9.3. Beschwerden werden innerhalb von 14 Tagen ab dem Datum des Eingangs bearbeitet.

10.1. Die Verantwortliche für die personenbezogenen Daten der Gäste ist Katarzyna Kosydar.
10.2. Die personenbezogenen Daten der Gäste werden zum Zweck der Erbringung von Unterkunftsdienstleistungen, der Vermarktung eigener Produkte und Dienstleistungen sowie für Zwecke, die sich aus den berechtigten Interessen des Verantwortlichen ergeben, verarbeitet.

11. Schlussbestimmungen
11.1. Für nicht durch diese Allgemeinen Geschäftsbedingungen geregelte Angelegenheiten gelten die Bestimmungen des lokal geltenden portugiesischen Zivilrechts.
11.2. Alle Streitigkeiten werden gütlich beigelegt, und bei fehlender Einigung durch das für den Sitz der Eigentümerin der Villa-Kasia Ocean View zuständige Gericht.

1.2. Właścicielem obiektu Villa-Kasia Ocean View, położonego na wyspie Madera, jest Katarzyna Kosydar, NIF: 304475998.
1.3. Dokonanie rezerwacji oraz korzystanie z usług obiektu Villa-Kasia Ocean View oznacza zapoznanie się z niniejszym Regulaminem oraz jego pełną akceptację.

2. Rezerwacja
2.1. Rezerwacji można dokonać:

- Poprzez portale rezerwacyjne, z którymi współpracujemy
2.2. Dokonanie rezerwacji wymaga podania danych osobowych niezbędnych do jej realizacji, w tym:
- Imienia i nazwiska
- Adresu e-mail
- Numeru telefonu
- Terminu pobytu
- Liczby osób
2.3. Po dokonaniu rezerwacji, Gość otrzyma potwierdzenie zawierające szczegóły rezerwacji oraz informacje dotyczące płatności.
2.4. Rezerwacja zostaje potwierdzona i zagwarantowana po wpłaceniu zadatku lub pełnej kwoty za pobyt. W przypadku rezerwacji dokonanych co najmniej 30 dni przed planowanym przyjazdem wymagany jest zadatek w wysokości 50% wartości pobytu. W przypadku rezerwacji dokonanych mniej niż 30 dni przed planowanym przyjazdem wymagana jest wpłata 100% wartości pobytu. Prosimy o zrozumienie, że do czasu wpłynięcia środków na nasze konto rezerwacja ma charakter wstępny. W tym czasie pokój może zostać zarezerwowany przez gości korzystających z portali rezerwacyjnych takich jak Airbnb, Booking.com czy Expedia. Aby zapewnić sobie wybrany termin, uprzejmie prosimy o dokonanie wpłaty w ciągu 2 dni od dokonania rezerwacji. Niewpłacenie w tym terminie może skutkować automatyczną anulacją rezerwacji.
3. Płatność
3.1. Akceptujemy następujące formy płatności:

3.2. Płatność za pobyt:

- W przypadku rezerwacji dokonanych mniej niż 30 dni przed planowanym przyjazdem - wymagana jest wpłata 100% wartości pobytu w momencie dokonywania rezerwacji
- Pełna płatność przy zameldowaniu (gotówka/karta) - ta opcja dostępna jest tylko dla gości, którzy są już na wyspie Madera i dokonują rezerwacji w ostatniej chwili (tego samego dnia lub dzień wcześniej)

3.4. Na życzenie wystawiamy faktury VAT. Wniosek o fakturę należy złożyć podczas rezerwacji lub najpóźniej w dniu zakończenia pobytu, podając niezbędne dane.
4. Zmiana i anulowanie rezerwacji
4.1. Zmiana terminu rezerwacji jest możliwa, pod warunkiem dostępności w nowym terminie i wymaga kontaktu z obiektem.
4.2. W przypadku anulowania rezerwacji:
- Ponad 30 dni przed planowanym przyjazdem - zwracamy 100% wpłaconej kwoty
- Między 30 a 14 dni przed planowanym przyjazdem - zwracamy 50% wpłaconej kwoty
- Mniej niż 14 dni przed planowanym przyjazdem - brak zwrotu wpłaconej kwoty
4.3. W przypadku skrócenia pobytu, opłata za niewykorzystany okres nie podlega zwrotowi.
4.4. W przypadku siły wyższej lub nieprzewidzianych okoliczności uniemożliwiających pobyt, decyzja o zwrocie wpłaconej kwoty będzie podejmowana indywidualnie.
5. Zameldowanie i wymeldowanie
5.1. Doba hotelowa rozpoczyna się o godz. 15:00 (zameldowanie) i kończy o godz. 11:00 (wymeldowanie) następnego dnia.
5.2. Wcześniejsze zameldowanie lub późniejsze wymeldowanie jest możliwe w zależności od dostępności i może wiązać się z dodatkową opłatą. Prośbę należy zgłosić z wyprzedzeniem.
5.3. Przy zameldowaniu Gość zobowiązany jest do okazania dokumentu tożsamości ze zdjęciem.
5.4. Klucze do pokoju należy zwrócić przy wymeldowaniu. Za zgubiony klucz pobierana jest opłata w wysokości 20 €.
6. Pobyt
6.1. W obiekcie obowiązuje całkowity zakaz palenia. Złamanie tego zakazu skutkuje naliczeniem opłaty za sprzątanie w wysokości 100 €. Wiąże się to z dodatkowym sprzątaniem i usuwaniem niepożądanych zapachów, w tym tytoniu czy innych substancji.
6.2. Cisza nocna obowiązuje od godz. 22:00 do 7:00. W tym czasie Goście zobowiązani są do zachowania się w sposób nie zakłócający odpoczynku innych Gości. Prosimy o ciche zamykanie drzwi przez cały pobyt.
6.3. Goście ponoszą odpowiedzialność finansową za wszelkie uszkodzenia lub zniszczenia wyposażenia obiektu oraz urządzeń technicznych Villa-Kasia Ocean View powstałe z ich winy lub winy ich odwiedzających.
6.4. Villa-Kasia Ocean View nie ponosi odpowiedzialności za wartościowe przedmioty pozostawione w pokojach. Zalecamy korzystanie z sejfu, jeśli jest dostępny w pokoju.
